Terms and Conditions for Appjail

Appjail provides a physical Device designed to aid in managing screen time, which is used in conjunction with the free companion Appjail App, available on mobile app stores. The Service also includes the Website where you can find information and purchase the Device. Features and functionalities of the Service may evolve over time.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

2. ACCOUNTS (FOR THE APP)

To use certain features of the App, you may need to create an account. You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. DEVICE PURCHASES AND PAYMENTS

Orders

By placing an order for a Device through our Website, you warrant that you are legally capable of entering into binding contracts. All orders are subject to availability and confirmation of the order price.

Pricing and Availability

While we try to ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any Device which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

Payment

Payment for Devices can be made through third-party payment processors such as Stripe or Shopify Payments. By providing payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

Shipping and Delivery

Shipping and delivery times are estimates only and cannot be guaranteed. Risk of loss and title for Devices purchased from Appjail pass to you upon delivery of the items to the carrier. You are responsible for any customs and import duties that may apply.

Returns and Refunds

You may return unopened Devices within 30 days of receipt for a full refund. Return shipping costs are your responsibility unless the item is defective. Please contact us at support@appjail.com to initiate a return.

Warranty

The Appjail Device comes with a one-year limited warranty against manufacturing defects from the date of purchase. This warranty does not cover damage caused by misuse, accident, or normal wear and tear.

4. USER CONDUCT AND RESPONSIBILITIES

You agree not to use the Service:

In any way that violates any applicable national or international law or regulation.
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
To transmit, or procure the sending of, any unsolicited advertising or promotional material.
To impersonate or attempt to impersonate Fokusbloks Oy, Appjail or any other person or entity.
To engage in any conduct which, as determined by us, may harm Fokusbloks Oy, Appjail or users of the Service.

5. INTELLECTUAL PROPERTY

The Service (including the Website, App, and design of the Device, excluding user-generated content) and its original content, features, and functionality are and will remain the exclusive property of Fokusbloks Oy and its licensors. The Service is protected by copyright, trademark, patent, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fokusbloks Oy.

6. USER CONTENT (IF APPLICABLE VIA APP/WEBSITE)

If our Service allows you to post, link, store, share and otherwise make available certain information ("Content"), you are responsible for the Content, including its legality, reliability, and appropriateness. By posting Content, you grant us a license to use, modify, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit.

7. TERMINATION

We may terminate or suspend your App account and bar access to parts of the Service immediately, without prior notice or liability, under our sole discretion, for any reason, including a breach of the Terms. If you wish to terminate your App account, you may simply discontinue using the App or contact us.

8. INDEMNIFICATION

You agree to defend, indemnify and hold harmless Fokusbloks Oy from and against any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising out of your use of the Service or your violation of these Terms.

9. LIMITATION OF LIABILITY

In no event shall Fokusbloks Oy be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Service or the Device. Our total liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the amount paid by you to us for the Device(s) in the last 12 months.

10. DISCLAIMER

Your use of the Service is at your sole risk. The Service is provided "as is" and "as available" without any warranty or condition, express, implied or statutory. Fokusbloks Oy does not warrant that the Service will function uninterrupted, secure, or error-free.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Finland.

12. CHANGES

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
